On 2 October, the IV Judicial Forum, organised by the Ukrainian Bar Association, was held in Hilton Kyiv Hotel. This year, the forum was conducted in two days. The first day was dedicated to investment attractiveness and competition of jurisdictions, practical implementation of the rule of law and fair justice. On the second day, discussion was mainly focused on the judicial reform, industry-related changes and international litigation.

Vitalii Bobrynov, the Managing Partner of Pragnum Law Firm, spoke on the theme “Topical Issues of Improvement of the Injunctive Relief Institution” at the section dedicated to private-law disputes. In his speech, Vitalii described the current problems of the injunctive relief institution in Ukraine, and shared his opinion on ways of its improvement. “Currently, injunctive relief in commercial disputes is a legal fiction that is applied contrary to rather than due to the applicable regulations. To my mind, the key objective related to improvement of this institute is to introduce the balanced injunctive relief mechanism based on equal rights and adversariality of litigants. It is the procedural balance that will liven up the injunctive relief mechanism and turn it into an efficient tool of the justice system,” Vitalii Bobrynov said to summarise his speech.
